Understanding County Court Judgments (CCJs) and Scottish Decrees in Debt Recovery

For law firms partnering with a legal collection agency, understanding the legal frameworks is key, especially when unpaid debts escalate to court action. In England and Wales, a CCJ may be obtained against a debtor who refuses to settle their owed money. However, in Scotland, the equivalent process results in a decree issued by the Sheriff Court.

Working with a legal debt recovery agency like Federal Management ensures that legal proceedings comply with jurisdictional requirements. Whether pursuing a CCJ, a Sherrif’s Decree or enforcing outstanding debt. Our firm has experience in court actions, enforcement and debtor tracing—all vital for legal proceedings.

How Our Legal Debt Collection Process Works

At Federal Management, we understand that every case is different. This is why our collection services and legal advice are tailored to each of our clients. We begin with a pre-action consultation to assess the severity of the debts owed by your customers and outline the involved costs.

Our professional collectors initiate contact through phone calls, formal letters and negotiation skills to encourage voluntary payment from customers. If these efforts are unsuccessful, we escalate using in-person visits and legal debt services such as insolvency proceedings.

For international cases, our global debtor tracing network ensures that even overseas debtors are contacted to recover what’s owed. While we always try to recover unpaid invoices without legal enforcement, we provide full support if legal proceedings become necessary.

Frequently Asked Questions

Debt collection for legal businesses can be complex, so we’ve answered some commonly asked questions below to clarify any uncertainties. If you don’t find what you’re looking for, please don’t hesitate to get in touch — we’re always here to help.

Traditional debt collectors like Federal Management focus on non-legal debt recovery processes, saving clients valuable time and money. We specialise in debt collection for law firms and various other business industries. This allows us to use expert negotiation skills and processes to claim back debt at minimal cost to the client.

On the other hand, a debt recovery law firm ensures that legal assistance is obtained immediately. Specialist debt recovery solicitors can represent creditors in legal proceedings and obtain a court order to recover business and personal debts. This type of debt recovery is only necessary if all attempts at negotiation fail. Fortunately, most cases taken on by us do not require a County Court Judgment (CCJ) or any form of court action.

Law firms should seek a debt collection service with extensive experience in navigating legal late payment issues and non-payment circumstances. Our debt recovery business has a proven track record of collecting debts, and we maintain a strict legal and professional work ethic.

When it comes to costs, debt collection businesses should prioritise transparent pricing and consistent communication, keeping the firm informed throughout the process.

While we do our best to fast-track the recovery process of your late payment, the time frame depends on many factors. Factors that affect the process include the amount and age of the debts, legal complications and debtor cooperation.

When no disputes are involved, we can typically resolve your claim in one to two weeks. More complex cases can take up to several months, especially if legal proceedings are necessary.

In Scotland, a Sheriff Court issues a decree instead of a CCJ. Decrees allow creditors to take enforcement actions like wage arrestment or property inhibition. Unlike County Court Judgments, decrees don’t require a separate enforcement order.

Law firms collecting debts in Scotland should work with Scottish collection agencies familiar with the laws and regulations of debt collection.

By working with global partnership networks, Federal Management can recover international debts from most countries. Many companies choose to partake in international trade thanks to the advancement of technology. However, no matter the industry, overseas debt can still disrupt your company’s cash flow and damage operations.

Our team of expert international debt collectors is fully committed to recovering invoices owed by customers. We operate under strict guidelines and regulations from the FCA and CSA, so you can rest assured that owed invoices are collected ethically and legally.

When a debtor refuses to pay, a structured process applies to recover the amounts owed:

  1. Letter Before Action (LBA): The creditor issues a formal notice to the debtor, detailing outstanding debt for invoices issued and warning of potential legal action.

  2. Legal Proceedings: If the LBA results in nonpayment, the creditor can initiate legal proceedings in the Sheriff Court to obtain a decree.

  3. Enforcement of judgment: Once a decree has been granted, the creditor can initiate enforcement actions known as ‘diligence’. These may include: Earnings arrestment (deductions made directly from the debtor’s wages), Bank account arrestment (funds in the debtor’s bank account are frozen and seized) and Attachment (Seizing and selling debtor’s moveable property).

It’s crucial to assess the debtor’s assets before proceeding with enforcement. By complying with the law, the chance of successful collection is increased.
